Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and PocketPress ("we", "us", "our") governing your use of the PocketPress desktop application and related services (collectively, the "Service").

By downloading, installing, or using PocketPress, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use PocketPress for personal or commercial video compression and conversion purposes, subject to these Terms.

This license does not grant you any ownership of the software or its source code.

2. Subscription & Lifetime Plans

2.1 Free Tier

PocketPress may be used without a license key with limited functionality. The free tier does not require payment or registration.

2.2 Pro Subscription

• The Pro subscription is billed monthly at the current listed price (approximately $1.50 USD/month or equivalent in your local currency).
• Your subscription automatically renews each billing cycle until you cancel it.
• You may cancel your subscription at any time through your Stripe account. Cancellation takes effect at the end of the current billing period.
• No refunds are issued for partial billing periods.

2.3 Lifetime License

• A one-time payment grants you perpetual access to all Pro features available at the time of purchase.
• Lifetime licenses are non-refundable after activation.
• Lifetime licenses are subject to the same device-locking restrictions as subscriptions (see Section 3).

2.4 Pricing

Prices are listed in USD. If your payment method uses a different currency, Stripe (our payment processor) will convert the amount at the prevailing exchange rate. We reserve the right to adjust pricing with reasonable notice.

3. Device Locking & Transfers

• Each license key can only be active on one device at a time.
• If you need to transfer your license to a new device (e.g., you bought a new computer), contact us at support@pocketpress.app with your license key and the reason for the transfer.
• We will reset your device lock upon reasonable verification. Excessive transfer requests may be declined.
• Sharing, selling, or distributing your license key to others is strictly prohibited and may result in immediate revocation.

4. Prohibited Use

You agree not to:

• Redistribute, resell, sublicense, or share the PocketPress software or your license key with any third party.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of PocketPress.
• Modify, create derivative works of, or tamper with the software, its license verification system, or its obfuscation mechanisms.
• Use PocketPress to process, compress, or convert content that is illegal, infringing, defamatory, or harmful under applicable law.
• Circumvent, disable, or interfere with any security, licensing, or usage-tracking features of the software.
• Use automated tools or scripts to abuse the Service's API endpoints or backend infrastructure.

5. User Content & Disclaimer of Responsibility

• You are solely responsible for the content you process using PocketPress.
• We do not monitor, review, or inspect any files you compress, convert, or extract.
• We are not responsible or liable for any content processed through the software, including but not limited to copyrighted material, explicit content, or illegal material.
• You represent and warrant that you have the legal right to process any content you use with PocketPress.

PocketPress is a neutral, general-purpose local utility designed exclusively for lawful media optimization. We have no knowledge, oversight, or control over the files or content you choose to process. You assume full and exclusive legal responsibility for any content you select, convert, or process through the software.

6. Intellectual Property

PocketPress, including its design, code, branding, logo, and documentation, is the exclusive property of PocketPress and is protected by intellectual property laws. All rights not expressly granted in these Terms are reserved.

PocketPress utilizes FFmpeg, which is licensed under the LGPL/GPL. FFmpeg's source code and license information are available at ffmpeg.org.

7. Privacy

Your use of PocketPress is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using PocketPress, you consent to the practices described in the Privacy Policy.

8. Warranty Disclaimer

PocketPress is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Any warranty that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
• Any warranty regarding the accuracy, reliability, or quality of compression results.

You acknowledge that video compression inherently involves trade-offs between file size and quality, and that results may vary depending on source material, settings, and hardware.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

• PocketPress shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption.
• Our total liability for any claim arising from your use of the Service shall not exceed the total amount you paid to PocketPress in the twelve (12) months preceding the claim.
• We are not responsible for any damage to your files, hardware, or system arising from the use of PocketPress.

10. Indemnification

You agree to defend, indemnify, and hold harmless PocketPress, its developer(s), affiliates, and contributors from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use or misuse of the Service;
• Any video, audio, image, or other content you process, compress, convert, or distribute using PocketPress;
• Your violation of these Terms or any applicable local, national, or international law, regulation, or third-party right.

11. Age Requirement

You must be at least 13 years of age to use PocketPress. If you are between 13 and 18 years old, you may use PocketPress only with the consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

Users under 16 in the European Union may require parental consent for data processing under GDPR. See our Privacy Policy for details.

12. Termination

• By you: You may stop using PocketPress at any time and cancel your subscription through Stripe.
• By us: We reserve the right to revoke your license key and terminate your access to the Service at any time if you violate these Terms or attempt to circumvent licensing protections.

Upon termination, your license key will be deactivated and you must cease all use of the software.

13. Modifications to These Terms

We may update these Terms from time to time. Material changes will be communicated through the application or via the email associated with your license. Continued use of PocketPress after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Portugal and the European Union. Any disputes shall be resolved in the competent courts of Portugal, without prejudice to any mandatory consumer protection rights under your local jurisdiction.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and PocketPress regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
